A seller who has decided to grant consumers the right to return a non-defective product shall, at its place of business, as well as upon sale and delivery of the product, provide written and accessible information about that right of return.

Credit notes

Article 5. If no agreement is reached on a refund or a new product in place of the one returned, the consumer is entitled to a credit note. A credit note refers to an authorization to withdraw an unspecified product for a specific amount. The validity period of a credit note towards the seller and those to whom he may transfer his commercial operations is four years unless otherwise stated on the credit note, but never less than one year.

Regarding Article 5.

It is emphasized here that if no refund is agreed or if the consumer believes that he cannot exchange the product for another product, he shall be entitled to a credit note. The Committee believes that it is not fair that credit notes are limited to one specific product type or product group. Therefore, it was considered necessary to define and specifically state what is meant by the term credit note. The Committee also believes that it may be unfair to the seller if there are no restrictions on the use of a credit note during a sale, cf. Article 9 and the discussion of it below. It should be noted, however, that the seller and the consumer can always agree specifically that the credit note is valid during a sale, either in full or as payment for the sale product at the pre-sale price and without the sale discount. The general rule is that a claim for credit under credit notes expires after four years, according to Act No. 14/1905, on the limitation of debts and other claims. The Committee considers it natural that a shorter period can be negotiated. However, such a period can never be less than one year. It is important that such claims are entered in the store's accounting and remain valid against those to whom the store owner may transfer his store operations.

Deadline

Article 2. In consumer purchases, goods may be returned within at least 14 days of delivery, provided that a receipt or comparable proof is presented. However, this provision never limits any better rights that consumers may have under law or a contract with the seller.

Regarding Article 2.

This states that when returning a product, the consumer must prove the purchase and the date of purchase by presenting a receipt or other comparable proof, such as a note that satisfactorily shows when the product was purchased. The procedural rules are primarily set to resolve problems regarding the return of non-defective products, i.e. the consumer's right to return. However, the law contains provisions on the consumer's remedies for non-defective products if the product proves to be defective, as well as time limits for reporting such defects. The procedural rules are in no way intended to replace such rules and can therefore never restrict the consumer's rights that he may have under the law. The same applies if the consumer and the seller reach an agreement that the consumer shall have more rights than are provided for in the minimum criteria. It is natural for this to be stated in the rules.

Return rules:https://www.stjornarradid.is/efst-a-baugi/frettir/stok-frett/2000/12/09/Skilarettur-verklagsreglur

Kaupandi getur skilað vöru keypt af seljanda innan 14 daga.
